TERMS AND CONDITIONS OF
USE OF www.eled.bg

 

The present Terms and Condition govern the relationship between the "Euro Property Management" Ltd. on the one side and Users of the websites, products and services found on domain www.eled.bg (hereinafter referred to as User), on the other.

"Euro Property Management" Ltd is a company registered under the Commercial Law of the Republic of Bulgaria Reg. num 175271319, with headquarters and registered office: Sofia, m.b. 1784, jk "Druzhba", bl. 94, email: sales@euro-pro.bg, phone: +359884586020.

"Euro Property Management" Ltd is registered as a data administrator and holds a Certificate of personal data administrator № 49952 issued by the Commision for Personal data Protection of Republic of Bulgaria.

Please read the published Terms and Conditions completely before using the information and commercial services offered by the site www.eled.bg (hereinafter Services). By visualizing www.eled.bg every user automatically undertakes to comply with the conditions described below.

This document contains information about "Euro Property Management" Ltd. and general Terms and conditions for use of the services provided by "Euro Property Management" Ltd. and governs the relationship between us and any of our registered users.

Confirmation of the Terms and Conditions is necessary and indispensable condition for the registration of each User and the conclusion of the contract between him/her and "Euro Property Management" Ltd. by pressing a virtual button "Register" it is accepted that you are familiar with the Terms and Conditions and agree to follow them.

Art. 1 The services and products provided by "Euro Property Management" Ltd to the User, constitute information society services under the Law on Electronic Commerce.

Art. 2 "eLEDbg" is an e-shop, accessible on site www.eled.bg, where Users are able to conclude contracts for sale and delivery of goods and services offered by "Euro Property Management" Ltd.

Art. 3 (1) "Euro Property Management" Ltd. identifies the site Users by storing log files on the server of www.eled.bg and the IP address of the User.

(2) "Euro Property Management" Ltd. has the right to collect and use information about Users after thier registration. The information used to identify a person may include name, surname, date of birth, gender, address, telephone number and any other information that the person given voluntarily when registering. The information includes any others that user enters, uses or provides when using services provided by "Euro Property Management" Ltd.

Art. 4 (1) "Euro Property Management" Ltd. due care and is responsible for protecting Users' information became known in the process of registration - subject to these Terms and Conditions, except in cases of force majeure, accident or malicious acts of third parties.

(2) The registration form filled in by the user during registration, "Euro Property Management" Ltd. denotes compulsory or voluntary nature of data provision and the consequences of refusing to provide them. By expressing agreement with the present Terms and Conditions the User agrees the information for it to be handled as provided therein.

(3) The restrictions under par. 1 shall not apply in case of "Euro Property Management" Ltd. obligation to provide personal information about the User to the competent National authorities in accordance with the applicable legislation.

Art. 5 (1) "Euro Property Management" Ltd. collects and uses information under Art. 5 for the purposes specified in these Terms and Conditions, as well as to offer new products and / or services to the User (free or paid). The purposes described herein for which the information is used, are not exhaustive and does not create obligations for "Euro Property Management" LTD.

(2) With the acceptance of the present General Terms and Conditions the User agrees to the processing of personal data for the purposes of this contract and direct makreting.

Art. 6 (1) To contract with "Euro Property Management" Ltd., the User is obliged to pre-register by filling out the electronic registration form, available in real time (on-line) on the Internet site of "Euro Property Management" Ltd., to agree to these terms and declare that he/she is qualified to use its services.

(2) By pressing the virtual button "Register" having the power of the written confirmation of the Terms and Conditions, the User performs an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, which declares that he/she is familiar with the present Terms and Conditions, accepts them and undertakes to respect them. With his recording of relevant media server used by "Euro Property Management" Ltd., through a common standard for technical conversion making  possible its reproduction, electronic statement acquires an electronic document within the meaning of the qouted Act. "Euro Property Management" Ltd. may store in log files on the server, which was granted the hosting site www.eled.bg, the IP addresses, and any other information necessary to identify him/her and recover the electronic statement acceptance of the Terms and Conditions in an event of a legal dispute. The text of the present Terms and Conditions is available on the Internet site of "Euro Property Management" Ltd. www.eled.bg in a way that allows its storage and recover.

(3) Upon completion of the registration application the User is obliged to provide complete and accurate information concerning the identity (for individuals), legal status (for legal entities) and other provisions required by the electronic form of "Euro Property Managment" Ltd. data and update them within 7 (seven) days from their change. The User declares that he/she agrees to provide such requested personal data, and ensures that the data provided in the registration process are true, complete and accurate and in case of change will update them promptly. In case of providing false information "Euro Property Management" Ltd. has the right to terminate or suspend immediately and without notice provision of services, and maintaining the registration of the User.

Art. 7 (1) Upon registration the User inserts / receive a unique username and password to access the services available through the website of "Euro Property Management" Ltd. www.eled.bg.

(2) The user name under which the User is registered, do not give him/her any other rights except the right to use a specific user name in the online shop of "Euro Property Management" Ltd. www.eled.bg.

(3) By registration as a representative of a legal entity the User is obliged to insert his/her full name and address, respectively the name of the entity he/she represents. By accepting the Terms and Conditions, the User guarantees and acknowledges that he/she has a contractual relationship with the registered by him/her company-user. The introduction of incorrect or misleading information the User is deprived of the right to access the services on the website of "Euro Property Management" Ltd. www.eled.bg.

(4) The User is obliged to take all care and take necessary measures reasonably required to protect his/her password and not to disclose it to third parties, immediately notify "Euro Property Management" Ltd. in case of unauthorized access, as well as probability and doubt about that. It is the User's responsibility and risk of protecting his/her password and for all activities performed by him/her or by a third party using the password.

Art. 8 (1) The User has the right to access to the goods / services provided by the website "Euro Property Menidzhant" Ltd in on-line mode
, subject to the conditions and requirements for access set by "Euro Property Management" Ltd. To be able to use the goods / services, the user must enter his/her user name and password.

(2) The User has the right of access and correction in on-line mode of personal data provided during registration.

Art. 9 (1) The Users use the "Euro Property Management" Ltd. website interface to conclude contracts of sale of the offered by "Euro Property Management" Ltd. goods / services in the online store.

(2) The contract of sale of goods / services is concluded by the time of placing the order by the User through the website of "Euro Property Management" LTD.

Art. 10 (1) To place an order, the User is required to register pursuant to the terms and conditions described in these Terms and Conditions and log in the system by identifying with his/her username and password.

(2) After selecting one or more products offered on the website of "Euro Property Management" Ltd., the User should add them to his/her list of goods for purchase ( "basket", "cart").

(3) The User must provide data for delivery and choose the method and timing of payment of the price, then confirm the order via e-shop interface.

(4) By placing the order, the User receives an e-mail confirmation that his/her order is accepted.

Art. 11 (1) The prices of products offered in the online store are those listed in the "Euro Property Management" Ltd. site at the time of the order, except in cases of an obvious error.

(2) The prices of products are quoted in the currency specified on the "Euro Property Management
" Ltd. online store, and include VAT (BG). The products are invoiced exclusively in the currency indicated on the "Euro Property Management" Ltd. online store www.eled.bg.

(3) Invoices shall be issued only in the name of the person / entity who placed the order.

Art. 12 "Euro Property Management" reserves its right to modify at any time and without notice the prices on the online store products / services, such changes will not affect orders already placed.

Art. 13 (1) "Euro Property Management" can provide discounts on products offered in the online store, according to Bulgarian legislation and rules set by the "Euro Property Management" Ltd. The rules applicable to such discounts are available on where the discount is shown. Discounts may be provided in various forms (eg. Promotions, rebates offered individually, randomly or as a result of participation in contest or client survey).

(2) Different types of discounts can be combined with ordering and purchasing the same commodity.

Art. 14 When the User returns a product with the right to a refund for any reason whatsoever, the price subject to refund shall be reduced by the value of the discount applied to the product, and only actually paid amount is refundable.

Art. 15 (1) The User may pay the price of the ordered goods by choosing one of the options available on the website. On www.eled.bg is possible payment by Cash on Delivery only on the territory of Bulgaria, by credit or debit card, bank transfer, via ePay.bg and PayPal.

(2) If the User chooses the option of delivery by courier and payment by Cash on Delivery, he/she must pay the price of ordered items together with the cost of delivery to the courier upon receipt of the goods.

Art. 16 If the User chooses a payment method involving a third party - a payment service provided, the User may be bound by the Terms and Conditions and / or charges of such third party.

Art. 17 "Euro Property Management" Ltd. is not responsible if a payment method involving a third party - a payment service provider is not available or otherwise not functioning due to causes beyond dependent of "Euro Property Management" Ltd. reasons.

Art. 18 (1) The delivery of ordered goods is carried by courier to specified by the User shipping address. Delivery is at the expense of the User, except for the cases explicitly specified on the online store site of delivery above specified amount and territory.

(2) Before delivering the goods ordered, "Euro Property Management" Ltd. has the right to contact the User on his/her phone to specify the details of the contract and / or delivery.

(3) "Euro Property Management" Ltd. is not responsible for breach of contract where the user has specified incorrect, incomplete and / or inaccurate personal data, including where indicated incomplete, inaccurate or fictitious address or phone.

Art. 19 Delivery is made within the terms described below each item for delivery interface module order. In exceptional circumstances "Euro Property Management" Ltd. reserves the right to extend the delivery promptly informing the User.

Art. 20 (1) The ordered products are delivered against signature, as larger items (at the discretion of the courier) delivered to the entrance of the building.

(2) The User is obliged to examine the goods when delivered and notify the courier immediately if detected inconsistencies, loss or damage. If the User fails to do so, it is assumed that the supply was adopted without objection.

Art. 21 (1) The inability or difficulty to be hand in personally to the addressee, the shipments are delivered as follows:
a) work address - to a person with who works at the address, noting the name of the person who received the consignment;
b) home address - to a member of the household, noting the name of the person who received the shipment.

(2) If it becomes impossible for shipment to be delivered, occurred through no fault of "Euro Property Management" Ltd. or the courier, the person performing the delivery is calling on specified by the Customer contact telephone number to be specified from which courier office the User may collect the delivery.

(3) Failing to establish contact with the User, the distance contract of sale terminates automatically as "Euro Property Management" Ltd. shall bear no responsibility to deliver the goods ordered.

Art. 22 "Euro Property Management" Ltd. reserves the right to modify existing methods of delivery and payment and / or terms and conditions thereof at any time by posting the available methods of delivery and payment on the website without any notice.

 

Art. 23 (1) The User has the right to cancel the contract without giving any reason, without compensation or penalty within 14 days from the date of acceptance of the goods by the User or by a third party.

(2) To exercise his/her right under this clause, the User must notify "Euro Property Management" of his/her decision to withdraw from the contract as specifies the goods intended to return by providing all data ganerated by the order and delivery including but not limited to contract price, data of the person who placed the order, details of the person who accepted the delivery and date of delivery.

(3) The User is obliged to return the goods in the form and in the original packaging in which they were accepted on by the User to "Euro Property Management" Ltd. or authorized by the laatter person within 14 days from the date on which the User has exercised his right of withdrawal.

(4) If case the User fails to executed his/her obligation in accordance with the preceding paragraph without informing "Euro Property Management" Ltd. for any delay and without providing a valid reason for the same, it is considered that he/she has withdrawn his/her statement for the exercise of withdrawal.

(5) "Euro Property Management
" Ltd. reserves the right to refuse acceptance of returned merchandise that is obviously used with the same technical characteristics, type and shape, but placed in the original packaging of the new goods supplied.

Art. 24 (1) The User has no right to cancel the contract in the following cases: products made according to individual specifications or clearly personalized; products that can deteriorate or products with a short expiration date; products can not be returned due to reasons relating to the protection of health or hygiene, which were unsealed after delivery; sealed sound and video recordings or sealed computer software which were unsealed after delivery.

(2) In the event that upon receipt of the returned goods is established that they are printed packaging factory (in the case of products which can not be returned for reasons relating to the protection of health or hygiene and sealed sound and video recordings or sealed computer software), "Euro Property Management" Ltd will have no obligation to reimburse the User the price paid.

Art. 25 'Euro Property Management" Ltd. reimburses the User the amount paid for returned goods to a specified by the User bank account or other appropriate method when the User speciefies it explicitly within 14 days of receipt of returned goods.

Art. 26 If the User finds a clear discrepancy of the goods with the contract, he/she has full rights to bring a claim under the provisions of the Act on Consumer Protection.

Art. 27 "Euro Property Management" Ltd. has the right in its sole discretion, without giving prior notice to terminate the contract, if it finds that the goods / services are used in breach of these Terms and Conditions, legislation in Bulgaria and generally accepted moral norms.

Art. 28 (1) Intellectual property rights on all materials and resources located on the "Euro Property Management" Ltd. website (including the available databases) are subject to protection under the copyright and related rights belong to "Euro Property Management" Ltd. or indicated persons / entities, ceded the right to use them by "Euro Property Management" Ltd. and can not be used in violation of current legislation.

(2) The right of access of the User does not include the right to use, copy or reproduce the information constituting the subject of intellectual property, unless it is an insignificant amount of information intended for personal use, in case that they are not unreasonably legitimate authors' interests or other holders of intellectual property rights in the event that copying or playback is performed for noncommercial use.

(3) When copying or reproduction of information outside of permissible under the preceding paragraph and any other violation of intellectual property rights over the resources of "Euro Property Management" Ltd. The User dues to "Euro Property Management" Ltd penalty equal of 10,000 (ten thousand) BGN for each violation. That amount of penalty does not deprive "Euro Property Management" Ltd. the right to claim compensation for greater damages than the amount of the penalty, where they are incurred.

(4) The user is obliged when using the access granted to him to the offered by the "Euro Property Management" Ltd. goods / services: to observe the Bulgarian legislation, these Terms and Conditions, Internet ethics, morality and decency; does not undermine the reputation of others and not calling for violent change of constitutional order, to commit a crime, to violate or incitement of racial, national, ethnic or religious hatred, not to preach fascist or other antidemocratic ideology not to violate others material or moral rights, including intellectual property; immediately notify "Euro Property Maagement" Ltd in case of violation done or found; not to interfere with the proper operation of the system, including but not limited to not frustrate the procedure of identification of other Users; not to make attempts for non-provided access, does not impair or impede the availability, reliability or quality of access granted, and do not use it in a way causing denial of its use; not extracted by technical means information resources or parts of information resources belonging to databases located on the "Euro Property Management" Ltd. and thus does not create its own database in electronic or other form; not to impersonate another person or otherwise mislead others about his/her identity or affiliation to a particular group of people; not to perform malicious actions under these Terms and Conditions.

(5) Except where expressly agreed, the User may not reproduce, modify, delete, publish, distribute and disclose otherwise information resources published on the website of "Euro Property Management" Ltd.

Art. 29 (1) "Euro Property Management
" Ltd is obliged to take due care to ensure that the User normal access to the services provided.

(2) "Euro Property
Management" Ltd. has the right to deactivate or delete username and password to access a User's profile, if the latter violates the intellectual property rights of "Euro Property Management" Ltd. on the information contained on the website elements - intellectual property.

(3) "Euro Property
Management" Ltd. reserves the right to suspend access to services provided after sending notice to the User's profile. "Euro Property Management" Ltd. has the right, but not the obligation, in its sole discretion to delete information resources and materials posted on its site.

Art. 30 (1) Except for the cases provided in these Terms and Conditions, the contract between the parties is terminated upon activity termination of "Euro Property
Management" Ltd. or termination of its website maintenance.

(2) The User may at any time in its sole discretion suspend the use of the services provided by "Euro Property Management" Ltd. services.

(3). Upon termination of the contract "Euro Property Management" Ltd. deactivates User's profile and deletes the password to access it.

Art. 31 Apart from the above cases, each party may terminate this contract by giving one week notice to the other party in the event of default under the contract.

Art. 32 The written form of the contract shall be deemed respected by sending an e-mail message (e-mail), pressing an electronic button on a page with content that is filled in or selected by the user or ticking a box (check box) website and other similar as long as the statement is technically recorded in a way that enables reproduction.

Art. 33 The parties declare that in case any / of the clauses in these Terms be / be invalid / and this will not entail the invalidity of the whole contract or its other clauses. The invalid clause will be replaced by mandatory rules of law or practice.

Art. 34 (1) "Euro Property Management" Ltd is obliged to notify users of any changes to these terms and conditions within 7 days of the occurrence of this circumstance specified by the User email address.

(2) When disagrees with changes in the Terms and Conditions, the User is entitled to cancel the contract without giving any reason and without compensation or penalty. To exercise this right, the User shall notify "Euro Property Management" Ltd. within one month of receipt of the notice under the preceding paragraph.

(3) If the user does not exercise its right to cancel the contract under the terms set out in these terms and conditions shall be deemed that the amendment is accepted by the User without objection.

Art. 35 By all outstanding hereof, the provisions of the legislation of the Republic of Bulgaria.
